Terms of Service

By accessing or using Tochiwo, you agree to these Terms. If you do not agree, do not use the service.

If you use Tochiwo on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Tochiwo lets users create, explore, publish, save, and play AI-powered visual novels. The service includes creator tools, AI generation, community features, paid features, and related discovery experiences.

We may change, limit, suspend, or discontinue parts of the service at any time. Some features may be experimental, usage-limited, paid, or unavailable in certain situations.

You are responsible for your account, credentials, sessions, and activity. Keep your login information secure and notify us if you believe your account has been compromised.

You must provide accurate account information and use Tochiwo only if you are allowed to do so under applicable law.

You are responsible for the content and activity you submit, create, upload, generate, publish, save, or share through Tochiwo.

You keep whatever rights you have in your content. You grant Tochiwo a worldwide, non-exclusive, royalty-free license to host, store, process, copy, display, adapt, distribute, index, analyze, and use your content as needed to operate, improve, promote, and protect the service.

When you publish content publicly, other users and visitors may view, play, save, rate, comment on, share, or otherwise interact with it through Tochiwo.

AI-generated output can be unpredictable, incomplete, inaccurate, similar to other content, or unsuitable for your intended use. You are responsible for reviewing and deciding how to use any generated output.

You should not rely on Tochiwo output as legal, medical, financial, safety, or other professional advice.

AI generation may use third-party providers, and generation may fail, be delayed, consume paid or limited resources, or be restricted by feature limits, safety systems, or provider rules.

You must not misuse Tochiwo or help others misuse it.

• Do not violate laws, rights, privacy, publicity, intellectual property, or contractual obligations.
• Do not upload or generate content you do not have the right to use.
• Do not attempt to access private content, accounts, systems, data, APIs, or infrastructure without authorization.
• Do not interfere with service operation, bypass limits, scrape at scale, abuse payments or AI generation, or reverse engineer protected parts of the service.
• Do not post spam, malware, phishing, harassment, impersonation, exploitative content, or content that promotes real-world harm.
• Do not use Tochiwo to create or distribute content that we determine is unsafe, unlawful, abusive, or incompatible with the service.

We may review, hide, remove, restrict, reclassify, or disable content or accounts if we believe they violate these Terms, create risk, receive credible complaints, or could harm Tochiwo, users, providers, or third parties.

We may preserve records where needed for security, billing, abuse prevention, legal compliance, dispute handling, or service integrity.

Some Tochiwo features may require a paid plan, subscription, coin pack, credit balance, or other paid entitlement. Access may depend on successful payment and active account status.

Coins, credits, and similar balances are limited digital feature balances for Tochiwo. They have no cash value, are not bank accounts, are not legal tender, and are not transferable except where Tochiwo expressly allows it.

Subscription benefits, grants, limits, prices, billing intervals, and feature costs may change. Refunds, chargebacks, taxes, and payment disputes may be handled by our payment providers or under applicable payment rules.

Tochiwo relies on third-party services for AI generation, hosting, storage, delivery, search, payments, security, analytics, and other operations. These services may have their own terms, policies, limits, outages, or moderation rules.

We are not responsible for third-party services outside our control, but we may change providers or routing as needed to operate Tochiwo.

Tochiwo, including its software, interfaces, branding, systems, documentation, and non-user content, is owned by Tochiwo or its licensors. These Terms do not grant you ownership of Tochiwo materials.

You may not copy, modify, distribute, sell, lease, or create competing services from Tochiwo materials except as allowed by law or written permission.

Tochiwo is provided as is and as available. We do not guarantee that the service will be uninterrupted, error-free, secure, accurate, available in every location, or suitable for every purpose.

To the maximum extent permitted by law, Tochiwo disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

To the maximum extent permitted by law, Tochiwo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, loss of goodwill, service interruption, or AI output issues.

To the maximum extent permitted by law, Tochiwo's total liability for any claim related to the service will be limited to the amount you paid Tochiwo for the service in the three months before the event giving rise to the claim, or 100 USD if you paid nothing.

You may stop using Tochiwo at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay amounts due, or use the service in a way that could harm Tochiwo, users, providers, or third parties.

Sections that by their nature should survive termination will continue to apply, including content licenses, payment obligations, disclaimers, liability limits, and enforcement rights.

We may update these Terms as Tochiwo changes. When we make material changes, we will update the effective date and may provide additional notice through the service.

Your continued use of Tochiwo after updated Terms take effect means you accept the updated Terms.
